General conditions of OWC Content Community Portal
            
1. OWC Content Community Portal (hereinafter called the "Portal”) is a mixed Web application constructed on the Alfresco Share Labs (GPL) platform in conjunction with development and adaptation implemented by One Way Clear S.L. using different technologies (Java, PHP, MySQL). One Way Clear S.L. (hereinafter called "OWC”), residing in C/Velázquez 112, 3ª, Madrid, constituted for an indefinite time by means of authorized writing in the presence of the Notary of Madrid D. Pablo de la Esperanza Rodríguez, in number 3,410 of his protocol, dated 15 September 2005, registered in the Mercantile Registry of Madrid, volume 21,796, book 0, sheet 1, inscription 1, page M-388317, puts this Portal at the disposal of the users of the Internet with the intention that its members can obtain data and share their experience on the solutions and services provided by OWC. It is a collaborative space which any participant can join, whether or not customers of OWC. In the Portal users will be able to be consult technical documentation, download software, participate in the forums, consult dates of events and launchings and perform all type of consultations and considerations.
 
2. The scope of the Portal is international and its existence is indefinite, notwithstanding the provisions in points 7, 8 and 9 of these general conditions.
 
3. The Portal is directed at physical users of the Internet. The registration in the Portal (which denominates the user as a member) and the participation within is free of charge

4. The explicit acceptance of these general conditions when registering in the Portal is a fundamental requisite. 
 
5. The user accounts generated as a result of the registeration process in the Portal are personal and non transferable, and their modification must be carried out or requested by the member. The accounts cannot be commercialized, transferred or resold.
 
6. Access to the Portal will be granted from the effective date of the registration process (which demands an explicit confirmation of the user’s email account by means of double opt-in). Access is confirmed by the delivery of access keys (username and password) by electronic mail to the new member at the address indicated on the registration form.
 
7. The status of member of the Portal will have an indefinite duration. The member will be able to cancel membership at any time by means of a corresponding communication in writing to the offices of OWC (situated in Calle Cronos 20, Building 2, Floor 3, 28039, Madrid, Spain) at least one month in advance of the date on which it is to become effective.  – surely people can cancel through email?
 
8. OWC reserves the right to cancel any member account whose actions threaten the security, stability or integrity of the Portal or whose behavior or language within the Portal is unsuitable or offensive, without requiring any type of communication, previous or subsequent, on the matter. 
 
9. Furthermore, the Portal can be cancelled without notification of the members, in case of causes of great force or legal impediments that affect or prevent its normal operation.
 
10. OWC informs that the personal contact data to be obtained through this Web is covered in rules of the Spanish Legislation of Protection of Data. This data will be stored in an automated file owned by OWC, whose purpose is to manage its property and participation in the Portal, in agreement with the Statutory law 15/1999 of “Protección de Datos de Carácter Personal” (Protection of Personal Character Data). In this fashion, and also in agreement with this legislation, OWC informs of the possibility of exercising the rights of access, rectification, cancellation and opposition by means of writing sent to ONE WAY CLEAR S.L, Calle Cronos nº20, Edificio 2, Planta 3ª, 28039, Madrid, Spain, Reference - OWC Content Community Portal.
 
11. The member accepts that registration in the Portal implies the necessity to receive informative communications concerning the contents of the Portal that can be of interest by telephone or email, and also including the possibility of SMS. In the case that he does not wish to receive these communications, the participant can revoke the consent, either online in the Portal, or by writing to OWC at the addresss mentioned above.
 
12. OWC informs of the adoption of the necessary technical and organizational measures and especially those established by the Regulation of development of the “Ley Orgánica de Protección de Datos de Caracter Personal” (Protection of Personal Character Data Law) and the other dispositions of development, to guarantee the security of the personal character data, avoiding its alteration, loss, treatment or non authorized access.
 
13. Fiscal responsibilities relating to the Portal, if any, will be assumed by the corresponding party, in agreement with the applicable legislation.
